The APEX Terms are subject to change. To the degree required by applicable law, APEX will provide User with reasonable advance notice of any material updates or modifications by any reasonable means of notification, provided that non-material changes, feature updates, or modifications made for legal reasons (as determined by APEX) will be deemed to be effective immediately and without notice. The alteration shall be in effect as of the “Last Updated” date listed atop this page.
Privacy Policy
By accepting the cookies prompt upon opening the website, APEX agrees that your information will not be shared on any third-party websites or given to any other companies. This promise will not be followed if your information is about sexual, racist or physical abuse or is needed to be showed to a trusted or / and authorized individual. To prevent uncomfortable feelings, only the first person to see the information has permission to use it.
Your continued use of the Services after the Last Updated date constitutes your approval and agreement to such changes.
The APEX Terms consist of the following:
- User Terms. The User Terms apply to any person who accesses the Services.
- Creator Terms. The Creator Terms apply to all Users who access the Services. They cover items such as the use of the Website Editor, the offering of Experiences and Virtual Content, and the use of music on the Services.
- APEX Community Standards. The APEX Community Standards apply to all Users and outline the types of behavior that are acceptable and prohibited when using the Services.
Payment and Refunds
- User Responsibilities. When purchasing from the Shop APEX, you (or your Guardian, as applicable) represent and warrant that you have the right to use your selected payment method and that your payment method has enough credit available to complete the applicable transaction. You further agree that you have read and agree to be bound by any applicable Additional Terms and that any information you provide in connection with any financial transaction on the Services, including without limitation the provision of a selected payment method, shall be subject to the privacy policy as outlined by the applicable payment service provider for that financial transaction.
- Chargeback Policy. If you notice charges on your credit/debit card, PayPal, or Google Play account that you did not authorize, please contact APEX Support before disputing any charges directly with your payment processor. Once a charge has been disputed with your payment processor, APEX cannot issue a refund due to prohibitions under the payment provider’s dispute process.
Imdemnification
You agree that you will be liable for your use of the Services, and you further agree to defend and indemnify APEX and the Affiliated Parties from and against every claim, liability, damage, loss, arising out of or in any way connected with: (a) your access to, use of, or alleged use of the Services; (b) your violation of any part of the APEX Terms, any representation, warranty, or agreement referenced in the APEX Terms, or any applicable law or regulation; (c) your actual or alleged violation of any third-party right, including any intellectual property right, publicity or privacy right, property right, or confidentiality obligation; or (d) any Dispute or issue between you and any third party. APEX reserves the right, at APEX’s own cost, to take on the exclusive defense and control of any matter subject to indemnification by you (without limiting your indemnification obligations with respect to that matter), and in that case, you agree to contribute to APEX’s defense of that claim.
Online Safety
APEX cares about the safety of its Users. If you see any content or materials on the Services that appears to recruit, entice, advertise, or solicit any person to perform a sexual, violent, or illegal act, please contact us.
Dispute Resolution between customers and creators
Escalation to APEX. While APEX is not responsible for the resolution of issues between Users and Creators or between Creators, APEX wants to make sure that everyone enjoys the Services. As a consequence, APEX has the right (but not the obligation) to interfere in issues between Users and Creators or between Creators to try to help resolve them. Before escalating any such issues to APEX, Users should first make a real, genuine effort to work out a resolution with the Creator. If such endeavour is ineffective, User may escalate the issue to APEX’s Customer Service team by completing the Contact form. If APEX chooses to intervene or take action in any dispute between a User and Creator or between Creators, User and Creator agree that APEX’s decision is final, and Creator and User will accept that decision. Users and Creators agree to work with APEX in a timely manner to resolve all such issues, and failure to do so shall be a infringement of the APEX Terms.

Final Enclosed Agreement [Between Users and Staff]
APEX is a private organization, meaning that your information will not be shared with anyone apart from when necessary because of health and safety. The money taken from you during the Shop APEX checkout stages will be used for the benefit of the organization as a whole and not for any one person. This will allow us to ensure the well being of our members, both staff and eSports players. The benefits that the money is converted to include better content and the motivation of our organization. We also use this money to perfect the content presented on here and help our community such as using the currency to employ more people into our communications team, thus more people will have their questions answered. This is an agreement inevitably signed by pressing 'Accept Cookies' as this is an automatic message displayed and he cookies are enclosed in this agreement. As we credit this agreement and will fulfil it, you must also accept this agreement that you understand the money that you have spent, however long ago, can not be refunded nor can it be reused by the shopper. [1] Our staff, when employed, promise no physical, mental or emotional abuse will be used against anyone, customer or collegue, and also promise that they will attempt to help the customer at all costs. At this promise, the customer must promise the same, and not to use any offensive actions, language or have any intentions of the same. [2] In this agreement, the Convention and Director of Communication all promise that the pleas of the Contacters and Customers will not remain silent unless authorized by a higher ranking staff member with permission and the appropriate reasons. [3] The Director also, by himself, promises no harm or abuse of power in the Corporation and / or Company that he is employed by. [4] This agreement is binded by the promise that any user of harm, abuse, mysogyny or discrimination / offensive actions, speech or intent will be removed from our staff and anyone who breaks these terms will be punished severely by the Corporation. [5] This agreement is in place meaning that it is not to be deleted or moved by any member of staff other than to be updated or have rules added to it, which must be permitted and adminstrated by Galaxius alone. [6] Galaxius promises to use his authority, power and influence, not for himself, but for the wider community and all APEX staff, members, employed figures, collaborating third-party companies / organizations, the contacts and customers of APEX eSports Ltd. and the general people and public of Fortnite and all other pieces of content displayed on YouTube, the internet or any online organization. [7] The enclosed agreement is that gambling, inappropriate use or unorthodox actions with money are to not be dismissed, but to result in a fine of that money.
